Section 5.7.2 Adjacent Lots

A. Adjacent Lot Offered Separately
If the Seller is offering an adjacent lot for sale separately from the listed Property, the adjacent lot must be entered into the MLS Database under a separate active listing. The Remarks field may state that the adjacent lot is separately available but may not imply that the lot is included in the sale or listing price of the listed Property. Additional details such as address, Property Identification Number (PID), corresponding active MLS number, and current listing price of the adjacent lot may be included in the Agent Comments field.

B. Adjacent Lot Included in the Listing
If the Seller is offering an adjacent lot only as part of the sale of the listed Property under the same MLS Listing, the Listing Agreement must identify both parcels, and the listing price and other Listing Content must accurately reflect the inclusion of both parcels.
The Remarks field may state that the adjacent lot is included in the sale and may identify the address and Property Identification Number (PID) of the adjacent lot. The Remarks field must clearly state that the adjacent lot will be conveyed with the listed Property.
A separate MLS Listing is not required for an adjacent lot that is not being offered for sale separately.
