Section 5.8.2 Virtual Staging

“Virtual staging” means the use of digital, artificial-intelligence, or other image-editing technology to add, remove, or replace furniture, furnishings, décor, or other nonpermanent personal property in a listing photograph. Any virtually staged photograph must:

A. Be clearly and conspicuously labeled “VIRTUALLY STAGED” or similar language on the photograph;

B. Be disclosed in the REMARKS field; and

C. Include an unaltered photograph of substantially the same view.

Routine adjustments to brightness, contrast, color balance, sharpness, cropping, or straightening are not considered virtual staging, provided they do not materially change the representation of the property.

Virtual staging may depict physically possible changes to landscaping, finishes, fixtures, or other elements within the property owner’s control, provided the altered photograph is clearly and conspicuously labeled “VIRTUALLY STAGED” or similar verbiage as applicable, and is displayed with an unaltered photograph of substantially the same view.

An altered photograph may not conceal a material defect, materially misrepresent the property’s dimensions, depict a physically impossible condition, or add, remove, or change elements outside the property owner’s control, including off-site structures or actual views.
