  • Article 6 – References new Appendix C regarding Arbitration Policy Statement

January 2023:

  • Section 5.6.2 – clarification on requirements for square footage substantiation for resale properties.
  • Section 5.32 – Co-exclusive Listings. Expands allowable co-exclusive listings to include agents of the same firm, even if one of the agents is not a Virginia CoOp MLS User.

  • Section 4.12 – Services Advertised as Free: Mandatory NAR language prohibiting agents form advertising services as free unless they will receive no compensation for their services from any source.
  • Section 5.4 – Seller Authorization and Forms: Clarification language that an active, written listing agreement is required to enter a listing in the MLS.
  • Section 5.6.3 – Property Address: Mandatory NAR language requiring a property address (or PID when an address does not exist) on a listing.
  • Section 7.6 – Right of Listing Participant in Presentation of Counter-Offer: Mirrors new COE language which allows listing broker to request written confirmation that a counter-offer has been presented to buyer/purchaser/tenant.
  • Section 9.5 – Multiple Violation: Clarification language regarding discipline a Compliance Panel may impose.
  • Section 10.12 – VOW Criteria for Excluding Listings: Removes cooperative compensation as an exclusion criteria.
  • Section 10.15 – VOW Restricted Information:
    • Renumbered to match NAR mandatory language
    • Removed compensation fields as restricted fields
  • Section 11.2.4 – IDX Criteria for Excluding Listings: Redefines criteria for excluded listings.
  • Section 11.2.7 – Renamed to Disclosure of a Brokerage Firm : Section redefined and language moved to other sections for better clarification and reference.
  • Section 11.3.1 – IDX Restricted Content: Language moved from 11.2.7 and reorganized to mirror NAR mandatory language.
  • Section 11.3.3 – IDX Listing Firm Identification: (Deferred implementation by NAR until 9/1/2022) Mandatory NAR language added requiring contact information (email or phone number) for listing firm as provided by the listing participant, to be added to IDX display.
  • Section 11.3.5 – IDX Required Disclaimers –
    • Language from 11.2.7 moved for easier reference
    • Mandatory disclosure language added for displayed offers of compensation.
  • Section 11.3.7 – Restricted Listings: Moved to 11.3.1

April 2021:

  • Section 4.7 - Listing Compliance: Revised to reflect mandatory NAR language regarding submission of listing data accuracy.
  • Section 4.11 – Fair Housing: Revised to reflect mandatory NAR language regarding reporting process for any potential fair housing violations in listing data
  • Article 9 - Compliance and Enforcement Procedures: Revised to reflect mandatory NAR language.
